These Terms of Service ("Terms") govern access to and use of the website korvane.in ("Platform"), operated by Riyak Das, a sole proprietorship registered in India, doing business as "Korvane" ("we", "us", "our"), and govern the purchase of products from us. By accessing the Platform, creating an account, or placing an order, you ("user", "you", "customer") agree to be bound by these Terms and our Privacy Policy, Shipping Policy, and Return/Refund Policy, each incorporated herein by reference. If you do not agree, please discontinue use of the Platform immediately.

2. Eligibility

You must be at least 18 (eighteen) years of age to place an order on Korvane, or must place orders through a parent or legal guardian if under 18. By using the Platform, you represent and warrant that you are legally capable of entering into a binding contract under the Indian Contract Act, 1872, and that all information you provide is accurate, current, and complete.

3. Account Registration

Where account creation is required, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Products, Pricing & Availability

•          All product descriptions, images, and specifications are provided in good faith and for illustrative purposes. Minor variations in colour, texture, or print placement may occur for printed products (deskmats, mousepads) due to manufacturing and screen-display differences, and shall not, on their own, constitute a defect.

•          Prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise at checkout.

•          We reserve the right to modify prices, discontinue products, or limit order quantities at any time without prior notice, without affecting orders already confirmed.

•          In the event of a genuine pricing or listing error, we reserve the right to cancel the affected order and issue a full refund; we will notify you if this occurs.

•          Fan-art and pop-culture themed products are created for personal use and fan appreciation. Korvane does not claim ownership of any third-party intellectual property depicted in such designs and will act promptly on any valid takedown request from a rights holder.

5. Order Placement & Acceptance

Placing an order constitutes an offer by you to purchase the listed products, subject to these Terms. An order is confirmed only upon our issuance of an order confirmation email or message. We reserve the right, at our sole discretion, to accept or reject any order, including in cases of: stock unavailability, pricing or listing errors, payment failure or suspected payment fraud, suspected policy violation, or inability to deliver to the specified address.

6. Payments

•          Payments are processed through third-party, PCI-DSS compliant payment gateways. We do not store your full card, UPI, or net-banking credentials on our servers.

•          All payments must be received in full prior to order dispatch, except where Cash on Delivery (COD) is explicitly offered and selected.

•          In case of a failed transaction where an amount has been debited, any resulting refund will be processed to the original payment method within the timeline specified by the relevant payment gateway/bank, typically 5–7 business days.

7. Shipping & Delivery

•          Estimated delivery timelines shown at checkout or on the Shipping Policy page are indicative and not guaranteed, and may vary due to courier delays, weather, regional restrictions, or force majeure events.

•          Risk of loss and title for products pass to you upon delivery to the shipping address provided at checkout.

•          It is your responsibility to provide an accurate and complete delivery address and a reachable contact number. We are not liable for non-delivery or delay caused by incorrect address information provided by you.

8. Cancellation, Return, Refund & Exchange

Cancellation, return, refund, and exchange requests are governed by our separate Return & Refund Policy, published on the Platform and incorporated into these Terms by reference. In summary:

•          Orders may be cancelled prior to dispatch by contacting support@korvane.in.

•          Since our products (deskmats/mousepads) may be made-to-order or customised, certain items may be marked non-returnable except in cases of transit damage, manufacturing defect, or incorrect item received — such cases must be reported within 24 hours of delivery with photo/video evidence.

•          Approved refunds are processed to the original payment method within 7 business days of approval.

9. Intellectual Property

All content on the Platform — including the Korvane brand name, logo, graphics, original product designs, website layout, and text — is the intellectual property of Korvane / Riyak Das and is protected under applicable Indian and international intellectual property laws. Unauthorised reproduction, distribution, or commercial use of this content is strictly prohibited.

Korvane respects the intellectual property rights of third parties. Any fan-art or pop-culture themed products are offered on a fan-appreciation basis; if you are a rights holder and believe a listing infringes your intellectual property, please contact support@korvane.in with details, and we will investigate and act promptly, including removal where warranted.

10. User Conduct

You agree not to: place fraudulent or speculative orders; submit false claims regarding non-delivery, damage, or defects; misuse promotional codes or referral programs; attempt to reverse-engineer, scrape, or interfere with the Platform's functioning or security; upload unlawful, defamatory, or infringing content; or otherwise engage in conduct that violates applicable Indian law. We reserve the right to refuse service, cancel orders, or restrict access for any user found in violation of this section.

11. Disclaimers & Limitation of Liability

•          The Platform and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, other than those which cannot be excluded under the Consumer Protection Act, 2019.

•          To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or products. Nothing in these Terms limits or excludes our liability for fraud, wilful misconduct, or any liability that cannot be excluded under Indian law.

•          Subject to the above, our total liability for any claim arising out of or in connection with an order shall not exceed the amount actually paid by you for the specific order giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless Korvane / Riyak Das, its employees, and representatives from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Platform, or violation of applicable law or third-party rights.

13. Force Majeure

We shall not be held responsible for any delay or failure to perform an obligation under these Terms where such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, strikes, courier/logistics disruptions, government action, or pandemics.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data, and is incorporated into these Terms by reference.

15. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, any complaints or concerns regarding the Platform or an order may be directed to our Grievance Officer:

16. Governing Law & Dispute Resolution

These Terms, and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of India.

Any dispute shall first be referred to good-faith negotiation between the parties for a period of thirty (30) days from written notice of the dispute. If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the competent courts at Chandannagar, West Bengal, India, and both parties irrevocably submit to this jurisdiction.

Notwithstanding the foregoing, consumers residing in India retain their statutory right under the Consumer Protection Act, 2019 to approach the appropriate District, State, or National Consumer Disputes Redressal Commission having jurisdiction over their place of residence.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

18. Amendments

We reserve the right to update or modify these Terms at any time, at our sole discretion. The updated Terms will be posted on the Platform with a revised "Last Updated" date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
